1. The hiring contract shall be between the hirer and Michael Martin (the
owners' Agent) and shall be deemed to be made subject to these Conditions of
Hire. The hiring contract is not effective until the hirer has paid a 25
deposit (one third deposit in the case of a one week booking) and has
received confirmation of the booking and an invoice for the hire fee balance.
All bookings are subject to these conditions unless the owners' Agent
confirms any alteration to them in writing.
2. An initial deposit of 25% (one third deposit in the case of a one week
booking) for the rental cost of the property is required with the booking
form to secure a booking. When the deposit has been received the owners'
Agent will confirm that the period required has been reserved for the hirer.
The balance of the invoice is payable two months prior to the reserved
period. For bookings made less than eight weeks prior to the reserved
period full payment is required with the booking form.
3. The hirer is responsible for the property during the hire period and
expected to take all reasonable care of it and leave the property in the
condition they found it with the exception of making up the beds which is the
responsibility of the owners' Agent. If the hirer is unable to leave the
property as they found it on arrival the owners' Agent can/will supply a maid
at 70FF per hour. The hirer is required to keep noise levels emitting from
the property and it's surrounds to reasonable levels. Any time involved with
liasing with neighbours or local police concerning unreasonable noise will be
charged to the hirer. A domestic deposit of 350 per two weeks is payable as
a deposit against the cost of electricity (by meter reading), laundry,
cleaning and any damages. If the hirer wishes to make use of the telephone a
further 350 per two weeks is payable as a deposit and the cost of the
telephone is calculated by a meter installed in the property or by an invoice
from France Telecom for the period of the rental. The owners' Agent will
post an account and the balance of all deposits paid within 8 weeks of the
end of the hire period. The required 350 in each case will be pro rated for
bookings of longer than two weeks.
4. The accommodation is available to the client from 16:00 hours (4pm) on the
first day of their booking and up to 10:00 hours (I0am) on the day of
departure. The time between 10:00am and 16:00pm is required to properly
clean the villa and any change to these times can only be made by prior
agreement with the owners' agent.
5. The owners' Agent shall not be obliged to accept an alteration to a
booking proposed by the hirer after the booking has been confirmed by the
owners' Agent. If an alteration is accepted then the owners' Agent reserves
the right to make an administration charge of 20 for every alteration made
more than 8 weeks before departure and for every alteration made after that
date a reasonable charge to be determined by the owners' Agent in accordance
with the additional work involved.
6. The owners' Agent and the owner will use their best endeavors to provide
the booking and accommodation specified by the hirer but the owners' Agent
reserves the right to cancel, modify or alter the booking or accommodation in
exceptional circumstances such as natural disaster, fire, accident etc. If
the owners' Agent materially alters the booking after confirmation the
owners' Agent will, if available, offer an alternative or refund to the hirer
all rental money paid in full and final settlement. Any refund will be made
by the same method as the hirer made the final payment. If a material
alteration or cancellation is made the owners' Agent will pay to the hirer
compensation per person over 12 years old as follows: 20 less than 8 weeks
before the hire starting date, 25 less than 4 weeks, 30 less than 2 weeks.
7. The hirer may cancel a booking by giving written notice to the owners'
Agent. If the cancellation notice is received 57 days or more before the
hire starting date only the 25% hire deposit and any insurance premium will
be forfeit. Within that period the following percentages of the hire price
will be payable as a cancellation charge by the hirer taking into account the
deposit held by the owners' Agent. 56-42 days, 50%; 41-28 days 75%; 27
days or less 100%. Any such cancellation cost in excess of the
deposits/payments held by the owners' Agent from the hirer must be paid
within 7 days of the charge arising notwithstanding the fact that the hirer's
insurance policy may cover it. It is the hirer's responsibility to claim any
insurance money due.
8. All villa prices are based on an exchange rate of 9.50 French francs (FF)
to 1 sterling. Should the sterling fall below 9.30FF to l sterling a
surcharge for the cost of the property only is payable in addition to the
January 1st 2000 published price.
9. As agents for the owners of the properties the owners' Agent cannot accept
liability for the breakdown of any mechanical or electrical equipment or for
blockage of any part of a properties drainage system. The owner or the
owners' Agent will however endeavor to arrange a prompt repair, when
possible, by reputable local contractors at the owner's expense.
10. The use of the accommodation and its amenities such as swimming pools,
etc. is entirely at the hirer's risk and except where caused by negligence of
the owner or the owners' Agent or their employees, no responsibility can be
accepted for death or injury of loss or damage to the hirer or the belongings
of the hirer, or their guests or their guests' belongings. The owners' Agent
can arrange Holiday insurance.
11. In no circumstances may more than the number of persons as shown in the
property description sheet or as stated by the hirer on the booking form
occupy a property except by written agreement with the owners' Agent who
reserves the right to refuse admittance to the property or ask the hirer to
vacate if this condition is not strictly observed at all times during the
hire period.
12. If the hirer is not entirely satisfied with the accommodation offered
he/she should immediately contact the owners' Agent's local representative in
France or the owners' Agent at the address below who will do all they can to
resolve the problem. Disputes arising out of or in connection with this
contact which cannot be amicably resolved are subject to English law. All
distances to towns, shops, restaurants, etc. are approximate.
13. The owner nor the owners' Agent will not accept any liability for matters
outside their control, but do accept liability for loss or damage sustained
by the hirer as a result of the owners' or the owners' Agents negligence or
the negligence of their employees and all claims arising under this condition
shall be subject to English law. The owners' Agent does not accept any
liability for loss, damage or injury resulting from negligence by the owner
of the property.
14. All travel tickets issued, bookings and other arrangements made by the
owners' Agent for the hirer other than the hire of the property are subject
to the conditions imposed by the persons, firms or companies providing such
transport, accommodation or services and details of such conditions are
available from the owners' Agent on request.
